Subclass-482 visa- At a Glance
Subclass 457 visa has a new name called Subclass 482 visa. Although the features of subclass 482 is like Subclass 457 visa. Subclass-482 is also known as TSS (Temporary Skilled Shortage) Visa.
What are the features of Subclass 482 visa
- It enables employer to access a skilled overseas worker if an appropriate skilled Australian worker cannot be found.
- A sponsoring business must nominate an overseas worker.
- The visa holder must be provided with remuneration and employment condition equivalent to an Australian worker in similar capacity.
- Employer needs to meet AMSR (Annual Market Salary Rate)
- “Non-discriminatory workforce” test will apply. Business must not have engaged in discriminatory recruitment practices. For example, if the employer workforce is predominantly made up of overseas workers.
- Must work in the same occupation for which the visa was granted. Condition 8607 will apply.
- There should not be any adverse information about the sponsoring business.
There are three streams of Subclass 482 visa
Short-term stream
- This allows a business to sponsor an overseas worker for a maximum of two years (or up to four years)
- Occupation must be listed on STSOL (Short-term Skilled Occupation List)
- Onshore renewal for further 2 years term.
- May apply again from outside Australia.
- Must meet the GTE (Genuine Temporary entrant criteria)
- Applicant should have at least two years of relevant work experience in nominated occupations and related roles.
- English proficiency requirement is overall 5 band and 4.5 in each band.
Medium-term stream
- This allows a business to sponsor overseas worker for a maximum of 4 years.
- Occupation must be listed on the MLTSSL (Medium and Long-term Strategic Skills List)
- May further renew while in Australia.
- English proficiency requirement is overall 5 and minimum 5.
- Potential to obtain permanent residency (PR) visa Subclass 186 or Subclass 187 visa.
Labour Agreement stream
This allows a business to sponsor overseas worker in accordance with a labour agreement with the Commonwealth
