Subclass 186 visa and Subclass 187 visa – At a glance

Subclass 186 visa and Subclass 187 visa allows an employer to nominate a skilled worker for permanent residency in three different streams.

Subclass 186 (Employer Nomination Scheme) Visa

• Subclass 186 visa is a permanent visa.
• An employer can nominate skilled overseas worker for subclass 186 visa.
• This is available nationally.
• The nominating employer should choose the appropriate stream.
• Applicant must not be over 45 years of age.
• The applicant must have at least 3 years of relevant work experience.
• Any mandatory licensing or registration requirement for the specified occupation must be held or eligible to hold.

Temporary Residence Transition (TRT) steam

• This is for Subclass 482 or subclass 457 visa holders, who have worked in Australia for a specified period with a nominating employer and who wish to offer a permanent
• This will also apply to applicants who held or had applied for a subclass 457 visa on 18 April 2017
• At the time of nomination, the applicant has worked for three years out of the previous four years in the position in relation to which the Subclass 457 visa or Subclass 482 visa was held.
• Nominated occupation must be on MLTSSL (Medium to Long Term Strategic Skills List) or associated list of regional occupations.

Direct Entry (DE) steam

• This is for the people potential side effects nominated by an employer for permanent residence.
• Nominated occupation must be on MLTSSL (Medium to Long Term Strategic Skills List)

Agreement stream

This is for the people sponsored by an employer through a labour agreement between the employer and the Minister.

Subclass 187 (Regional Sponsored Migration Scheme) Visa

• Subclass 187 visa is a permanent visa.
• An employer can nominate skilled overseas worker for subclass 187 visa.
• This is visa is for the worker who wants to work in regional Australia.
• The position must be located at a place in regional Australia.

Direct Entry (DE) steam

• The employer must demonstrate that an Australian citizen or Australian permanent resident cannot fill the position.
• Must be endorsed by a Regional Certifying Body (RCB) from where the position is located.
• Must have worked in the same occupation and at the same level (not lower) when nominated in TRT stream.
• Business should be able to demonstrate that it has the capacity to lawfully and actively operate and employ for at least two years and pay the AMSR ((Annual Market Salary Rate)
