Subsequent entrant (subclass 482)
The Subsequent Entrant Visa is designed for family members of subclass 457 and Temporary Skill Shortage (TSS) visa holders who wish to join the primary visa holder in Australia. Typically, this visa is applied for at the same time as the main applicant's visa application. However, in certain situations, you may need to apply separately, a process referred to as a subsequent entrant application. This occurs when the family composition changes after the main applicant has already applied for their TSS visa or when the primary TSS visa has already been granted.
With the Subsequent Entrant Visa, you can live, work, and study in Australia. However, you won’t receive government assistance for your studies. You can also travel to and from Australia as many times as you want while the visa is valid. If eligible, you can apply for permanent residence.
In a subsequent entrant application, you must attach a written letter from the sponsor extending their sponsorship obligation to include you as a family member in the nomination. Discuss this with the sponsor before lodging your subsequent entrant visa application.
You can apply for this visa whether you are in or outside Australia when you apply, but not in immigration clearance. If applying in Australia, you must hold a substantive visa, Bridging visa A, Bridging visa B, or Bridging visa C. In some cases, you may be able to apply even if your substantive visa has a “no further stay” condition attached to it.
HOW LONG YOU CAN STAY
This is a temporary visa, and you can stay in Australia as long as your visa is valid. If the primary visa holder wishes to stay longer, their employer may need to submit a new nomination, and you must apply for a new visa. Permanent residency options are also available for the primary applicant.
INCLUDE OTHER FAMILY MEMBERS
Family members eligible for this visa are those who are part of the family unit of the primary subclass 457 or TSS visa holder. Family members applying for the visa must meet health and character requirements.
PRIMARY VISA MUST HAVE BEEN SUBMITTED OR DECIDED
Family members cannot be added to a primary visa applicant’s TSS visa application after it has been submitted. Therefore, a subsequent entrant application should be submitted if the primary visa applicant has already submitted their visa application and you were not included as a family member in their application.
The cost of the subsequent entrant visa application varies depending on whether the primary visa holder holds a TSS visa or a subclass 457 visa. For TSS visa holders, the cost is calculated based on the stream in which the primary visa was granted (short-term, medium-term, or labour agreement stream). If the primary visa holder holds a subclass 457 visa, the charges are as follows:
Base application charge: AUD3,035.00
Additional applicant charge for applicants 18 and over: AUD3,035.00
Additional applicant charge for applicants under 18: AUD760.00
Other costs may include health checks, police certificates, and biometrics.
You and your family must meet all visa conditions and comply with Australian laws. Specific conditions may apply to your visa, such as not being disruptive, maintaining adequate health insurance, and working in the nominated occupation.
Processing times vary based on individual circumstances and the completeness of your application. You might be asked for more information, and the Department can make a decision based on the provided information.
